Rafael Domingo Oslé (born in Logroño, La Rioja, 1963) is a Spanish legal historian and professor of law.[1]

Education edit

Domingo received his bachelor's and doctorate degrees in law from the University of Navarra.[2] He conducted legal research as a Humboldt research fellow at Ludwig Maximilian University of Munich, Germany starting in 1989,[3] and as a visiting scholar at the Columbia Law School in New York City.[4]

Academic and professional activities edit

In 1989, Domingo was awarded academic tenure at the University of Cantabria and promoted to associate professor.[5] In 1993, he was elevated to professor of law.[6] In 1995, Domingo joined the University of Navarra School of Law, where he served as dean (1996–1999), and was the founding director of the Garrigues Chair in Global Law.[7]

In 2011–12, Domingo was a joint Straus Institute and Émile Noël Fellow at New York University (NYU) School of Law.[8][9] Since 2012, he has served as Francisco de Vitoria Senior Fellow and the Spruill Family Professor of Law and Religion at the Center for the Study of Law and Religion at Emory University in Atlanta.[10] In 2020, Domingo was appointed the Álvaro d'Ors Professor of Law at the Institute of Culture and Society at the University of Navarra.[11]

Honors and awards edit

Domingo has been awarded the Toribio Rodriguez de Mendoza Medal of Honor from the Peruvian Constitutional Court (2006);[12] the Rafael Martinez Emperador Award from the Spanish Council of the Judiciary (2007);[13] the Medal of Honor from the Paraguayan Academy of Law (2009);[14] the Jose Barandiaran Medal of Honor from the National University of San Marcos (2016);[15] and the Honorary Diploma from the Congress of the Republic of Peru (2016).[4]

Domingo received honorary doctorates in law from Inca Garcilaso de la Vega University (2012)[16] and the University of Saint Ignatius of Loyola (2016),[17] both in Lima (Peru).

Views on law edit

Domingo believes that due to worldwide economic crisis, a system of global justice is necessary to address crimes against humanity, and that the democratic deficits of international institutions highlight the need for an innovative and truly global legal system[18] that permits humanity to reorder itself according to global needs and evolving consciousness.[19]

Domingo is a supporter of the Campaign for the Establishment of a United Nations Parliamentary Assembly, an organization that advocates for democratic reform of the United Nations.[20]

Domingo has analyzed the nature of the Roman legal concepts of auctoritas (moral authority) and potestas (constituted power).[21]

Domingo has advocated for a theistic conception of the secular legal system that also includes and protects non-theistic approaches.[22]
