The Human Rights Situation Report 2009

EXECUTIVE SUMMARY
Year 2009 has been marked by an increase in restrictions on the freedom of expression, especially against politicians and representatives of civil society organizations critical of the Cambodian Government. Consequently, at least twenty-two complaints were filed by government officials against dissident politicians and civil organization representatives, with an additional twenty-five complaints against journalists.

Admissibility of Civil Parties in Case 002

The Office of the Co-Investigating Judges (OCIJ) has ruled on the admissibility of 3988 submitted Civil Party applications this month (1821 were submitted over ADHOC). The Co-Investigating Judges have declared so far 2123 applications admissible. However a number of inadmissible decisions have been appealed by the Civil Party lawyers.

To this point 1053 Civil Parties were recognized who submitted their Victims Information Form over ADHOC. With this decision ADHOC is starting to further strengthen the nationwide Civil Party Representative system to ensure the communication with the Civil Parties across Cambodia.

Pressconference on Injustice taken by Kandal court arrest land's owner and let company grab land

The Cambodian Human Rights and Development Association (ADHOC) would like to strongly condemn against the injustice actions of the authority and the court in Kandal province, accusing and arresting the village representatives who had won the lawsuits cases in final judgments’ numbers No. 12 (v) and No. 40 (v) judged by the Kandal provincial court. This long-lasted land conflict broke out in 2005 and until this date there are no levels of authorities concerns on this case to take actions for the resolution.  On the other hand, whenever the villagers tried to struggle and stand up to protest in provincial and national level to protect their land and houses, there were always armed forces of the company, shot 3 villagers get permanently wounded, one villager was illegally imprisoned and other 2 villagers are under the arrest.  Furthermore, 292 families who have being threatened to be evicted from their houses and worried that the Tuol Ta Mok Pagoda would be destroyed due to that the company has set up the ultimate deadline. 

Press Statement on Severe Human Rights Violation on Cambodian Migrant Workers Overseas

Cambodia Human Rights and Development Association (ADHOC) is extremely concern on the issue confronting Cambodian migrant workers, who suffered from severe human rights violation from employers and companies who hired these workers to work as domestic workers overseas. 

ECCC at a Crossroad: Making Victim Participation Meaningful ahead of the Second Trial

With the ECCC’s Judges meeting this week at their Plenary Session, the Cambodian Human Rights Action Committee (CHRAC), the International Federation for Human Right (FIDH) and the Cambodia Justice Initiative (CJI) urge the Court to learn the lessons from the past, to overcome the inadequacy in the current system and to prepare for a meaningful participation of victims and civil parties in the Court’s second and most important trial. In particular, we want to point to three areas where improvement is urgently needed: outreach, reparations and effective assistance through the Victims Support Section.

 In the evening of the verdict day in Case 001 a panel discussion was organized by the Open Society Justice Initiative. ADHOCs president THUN Saray participated in the panel, next to the US War Crimes Ambassador at large Stephen Rapp, UN Secretary-General Assistant Clint Williamson, ECCC Deputy Prosecutor William Smith, ECCC National Prosecutor CHEA Leang, ECCC Head of Defense Richard Rogers, DC-Cam Legal Advisor Dr. John D. Ciorciariand Civil Party and Representative from KsemKsan CHUM Sirath. The penal was moderated by Heather Ryans, OSJI.

Preparatory Meeting Civil Parties in Case 001 & Exhibition of Victims Participation in Case 001

Mr. Thun Saray, president of ADHOC made following welcoming remarks: “With the exhibition today, we expect that the voices of the victims of crimes committed during the Khmer Rouge regime, especially in S-21 security center, will be loudly heard and strengthened. Their participation has a great deal of personal meaning and allows them to share these participatory experiences with their relatives and neighbors in their respective communities.”

3 representatives accused in Economic Land Concession related dispute with HLH Co.Ltd

3 land representatives have been charged with the attempt of killing and with use of violence against others after a complaint filed by HLH Agriculture Co. Ltd. The 3 representatives will be forced to appear in court's room for interrogation on 27 July 2010 following the subpoena issued by Kompong Speu Court's investigative judge, in date of 12 July 2010. The 3 innocent people are afraid of being arrested.                

Domestic Homicide in Krouch Chmar District, Kompong Cham

On 28 April 2010 at Pram Muy village, Kroch Svey Kling commune, Krouch Chmar District, Kompong Cham province, a woman named Heng Thea got stabbed by her husband named Im Earm on the neck and under her left shoulder with a cleaver.
