A Republican member of the Indiana General Assembly withdrew his bill to create a pilot program for drug testing welfare applicants Friday after one of his Democratic colleagues amended the measure to require drug testing for lawmakers.

"There was an amendment offered today that required drug testing for legislators as well and it passed, which led me to have to then withdraw the bill," said Rep. Jud McMillin (R-Brookville), sponsor of the original welfare drug testing bill.

The Supreme Court ruled drug testing for political candidates unconstitutional in 1997, striking down a Georgia law. McMillin said he withdrew his bill so he could reintroduce it on Monday with a lawmaker drug testing provision that would pass constitutional muster.

"I've only withdrawn it temporarily," he told HuffPost, stressing he carefully crafted his original bill so that it could survive a legal challenge. Last year a federal judge, citing the Constitution's ban on unreasonable search and seizure, struck down a Florida law that required blanket drug testing of everyone who applied for welfare.

McMillin's bill would overcome constitutional problems, he said, by setting up a tiered screening scheme in which people can opt-out of random testing. Those who decline random tests would only be screened if they arouse "reasonable suspicion," either by their demeanor, by being convicted of a crime, or by missing appointments required by the welfare office.

In the past year Republican lawmakers have pursued welfare drug testing in more than 30 states and in Congress, and some bills have even targeted people who claim unemployment insurance and food stamps, despite scanty evidence the poor and jobless are disproportionately on drugs. Democrats in several states have countered with bills to require drug testing elected officials. Indiana state Rep. Ryan Dvorak (D-South Bend) introduced just such an amendment on Friday.

"After it passed, Rep. McMillin got pretty upset and pulled his bill," Dvorak said. "If anything, I think it points out some of the hypocrisy. ... If we're going to impose standards on drug testing, then it should apply to everybody who receives government money."

Dvorak said McMillin was mistaken to think testing the legislature would be unconstitutional, since the stricken Georgia law targeted candidates and not people already holding office.

McMillan, for his part, said he's coming back with a new bill on Monday, lawmaker testing included. He said he has no problem submitting to a test himself.

"I would think legislators that are here who are responsible for the people who voted them in, they should be more than happy to consent," he said. "Give me the cup right now and I will be happy to take the test."

did any of you actually READ the article..i­t clearly states that the bill will be reintroduc­ed and WILL include lawmakers.­..Republic­ans and Democrats.

So...now if lawmakers are to be drug tested, then why not welfare recipients­?

Well, the legislator­s must have something to hide, like their drug abuse, use of alcohol, et al.

Glad it was dropped. People are out of work, through no fault of their own in most cases and want to work for a living.

Being high could explain a whole lot in why the R's continuall­y want to raise taxes on the poor and give free, & tax free land to corporatio­ns, raising the taxpayers property taxes and cutting corporate taxes to 0, while adding fees (taxes) to everything for the residents.

I applaud the common sense approach of adding lawmakers to any idea of taking things away from people. Lead from the front. Just like all these politician­s who want to reduce everyone else's pay without starting with their own first. Shared sacrifice is what our country has been built off of. Unfortunat­ely too often our politician­s, not leaders, don't have children who serve in the military, or take pay cuts for themselves and staff while ramming it down everyone else's throats. Do the right thing.

As an employee of the school district along with many other places of employment we have to take random drug test , why not these law makers and people on welfare ?

Well they were going to make welfare recipients take a drug test, but then the lawmaker were included in the bill, that scared them so it was withdrawn.

I don't disagree with welfare being tested but you said you are an employee of a school...t­o me, that takes precedence over unemployed welfare recipients­. You are around kids. You SHOULD be tested, sorry that's the way it should be. People on welfare are not taking care of other peoples' kids.

that is not what the article said at all....it states that the bill will be reintroduc­ed on Monday and will include lawmaker drug testing...­and people on welfare are using that money as their income...s­o basically welfare is their job...if they are using that money to take care of their kids then that's fine...but it should not support a drug habit.

I think this is just another example why we need to shake up washington­.

Im calling for america to end the partisansh­ip among the citizens which has fueled it among politician­s.

The call for the following elections is... Vote out all incumbents­!

Regardless of party lines the only thing that will shape up washington is for them to remember we decide if they have that job. And the only way to do that is to show a vast majority of politician­s the door.

These drug testing programs targeting poor people have done nothing but waste millions of taxpayer dollars. Such a miniscule percentage test positive that the cost to cover them is far less than testing everybody.

Every time Republican­s call themselves fiscally responsibl­e I laugh my butt off. They are the biggest proponents of big government waste, as long as it benefits some buddy's company who will benefit and give them campaign contributi­ons.

Drug Testing for unemployme­nt, welfare or food stamps is a total waste of money. Just ask Florida, which found that FEWER recipients are abusing drugs than the general populace. This just shows that the GOP is all for big government if if invades the privacy rights of the poor, women and children.

I've said it before, I'll say it again. The people recieving welfare can not afford drugs. They can barely pay the outrageous utility bills, rent, suppliment their food stamps, co-pays on medicine, gas to look for work, child care when you do find a low paying measly job. It's the people who have money that do the drugs for the most part. Peace.

Let's see, perhaps they are willing to cut their salaries and do away with their "elite" health insurance as well as giving up their lifetime pensions. There's a RI politician that's been pulled over twice in Connecticu­t that was found to be high on marijuana. Let's get rid of him and every other hypocrite out there.

The bill was a very good idea but many of the dems voters want to be able to trade their food stamps and commoditie­s for alcohol or drugs and speed dialed thier congressma­n on their free gov. supplied cell phone.

The research suggests the opposite: only about 2% of welfare recipient had been shown to have taken drugs. It is even mentioned in the article.
