(9th Cir.) A Chinese copy of an American company’s traction hoist, used in tasks such as window washing, imitated a design that was functional. The design did not qualify for trade dress protection under the Lanham Act.

SECURITIES - Strategic Diversity, Inc. v. Alchemix Corp.

(9th Cir.) Plantiff Kenneth Weiss and his wholly-owned corporation Strategic Diversity, Inc. seeking recission of investment in Alchemix Corporation based on section 10(b) of the Securities and Exchange Act of 1934, fraud and other counts was required to demonstrate economic loss and the court remanded the case for determination of loss.

EMPLOYMENT – Duran v. U.S. Bank

(Cal.Ct. App., 1st Dist.) A $15 million judgment against U.S. Bank over unpaid overtime for bankers is reversed, because the trial court’s trial management plan denied due process to U.S. Bank. The plan called for the use of a small sampling of class members to determine liability, denying U.S. Bank the opportunity to disprove other class members’ claims.
