ENTERTAINTMENT LAW – Aluise Entm’t Inc. v. Jeffrey Sachs
COMPLAINT – Sachs sold the film rights for his book, The End of Poverty, to Aluise for $50,000, agreeing to appear as narrator of the film. Plaintiffs allege that Sachs failed to follow through and cooperate on making, and appearing in, the film. They ask for specific performance, or for damages. (Super. Ct. Cal.)
SPAM - Facebook Inc. v. Power Ventures Inc.
ORDER - All of Facebook’s summary judgment motions were granted where overwhelming evidence showed Power Ventures, and Steve Vachani, owner and operator violated Controlling the Assault of Non–Solicited Pornography and Marketing Act (CAN–SPAM), Computer Fraud and Abuse Act (CFAA) by unlawfully accessing its website to send unsolicited and misleading commercial e-mails to website users. OPINION - Evidence that a father sexually abused his girlfriend's daughter was sufficient to support a dependency court's jurisdictional findings that the father presented a risk of physical harm and sexual abuse to his own ten-year-old and twelve-year-old sons, his own five-year-old daughter, and the girlfriend's nine-year-old daughter.
