INSURANCE – State v. Continental Ins. Co.
OPINION – The California Supreme Court has ruled the state is entitled to treat all of its insurance policies covering a court-ordered cleanup of an industrial waste site as one giant “uber policy” with coverage equal to the sum of policies’ limits. (Cal.)
INSURANCE – Nat’l Football League v. Fireman’s Fund Ins. Co.
COMPLAINT – The NFL claims that the named insurance companies failed to defend the NFL in personal injury suits brought by former players that were usually related to the NFL’s alleged failure to protect players from the effects of concussions. The NFL seeks a declaration of the insurance companies’ duty to defend, plus unspecified damages. (Cal.Super.)
DISCOVERY – S.E.C. v. Mercury Interactive LLC
OPINION – Mercury inadvertently supplied privileged documents to the S.E.C. Instead of re-supplying documents without privileged material, Mercury’s counsel asked the S.E.C. to delete certain documents. The S.E.C. then inadvertently deleted relevant documents. Sanctions are not warranted, but the S.E.C. cannot take advantage of the absence of documents it deleted. (N.D. Cal.)
