TRADE SECRETS – TelSwitch Inc. v. Billing Solutions Inc.

OPINION – TelSwitch claims former licensee BSI misappropriated trade secrets. Under Cal.Civ.Proc.Code § 2019.210, TelSwitch must formally disclose the trade secrets before discovery. BSI argued that the disclosure was not specific enough. The court allowed the disclosure to stand, but TelSwitch is limited to what was actually disclosed. (N.D. Cal.)

CONTRACTS – PNC Equip. Fin. LLC v. Cal. Fairs Fin. Auth.

OPINION – PNC and the Fairs Authority had a contract for renting solar equipment for fairs like El Dorado. El Dorado was told it would own the equipment at the end of the rental period, but that provision was not written in the contract. El Dorado may be able to produce parol evidence that the contract should be rescinded because of mistake; motion to dismiss denied. (E.D. Cal.)

CYBERSQUATTING – Petroliam Nasional Berhad v. GoDaddy.com Inc.

BRIEF – Internet domain name registry GoDaddy argues that the court’s decision in Lockheed makes it clear that domain registrars cannot, as a practical matter, police the alleged cybersquatting activities of their customers. Appellant wants to assert a claim of “contributory cybersquatting” that GoDaddy urges the court to reject. (9th Cir.)
