CONTRACTS – Sun Pacific Mktg. Co-op Inc. v. DiMare Fresh Inc.
OPINION – DiMare contracted to buy tomatoes in bulk from Sun. The contract included a clause that Sun would be excused from performance if an Act of God made performance impossible. After a heat wave, Sun did not perform and sought to be excused. However, Sun’s own packing records are unreliable in showing it had any shortage. (E.D. Cal.)

OPINION - Testimony of a witness implicating alternate suspect and casting doubt on prosecution of capital defendant was excluded by California court. Federal court held exclusion was subject to more than mere “harmless error” analysis. (9th Cir.)
