BANKRUPTCY – Stan Lee Media Inc. v. Conan Sales Co. LLC

BRIEF – As part of its bankruptcy ten years ago, Stan Lee Media agreed to sell the rights to the character Conan the Barbarian to Conan Sales. Now Stan Lee Media wants relief from the bankruptcy court order approving the settlement. But Conan Sales argues that the court was correct not to offer the relief under Rule 60(b)(6). (9th Cir.)

JUVENILE LAW - L.A. v. Superior Court ex rel. Cnty. of San Diego

OPINION - A juvenile may be ordered incarcerated during school hours or outside of school hours without violating Education Code § 601, for egregious behavior including truancy, defiance, disruption, tardiness, stealing, and conflict. (Cal.Ct. App., 4th Dist.)

CONTRACTS – Sun Pacific Mktg. Co-op Inc. v. DiMare Fresh Inc.

OPINION – DiMare contracted to buy tomatoes in bulk from Sun. The contract included a clause that Sun would be excused from performance if an Act of God made performance impossible. After a heat wave, Sun did not perform and sought to be excused. However, Sun’s own packing records are unreliable in showing it had any shortage. (E.D. Cal.)
