OPINION - California statute prohibited death penalty for offenders under the age of 18 but established a presumption of sentence of life without parole, giving judge discretion to choose less severe sentence. U.S. Supreme Court’s Miller decision required LWOP to be rare, and presumption was violation of Eighth Amendment. (Cal.Ct. App., 1st Dist.)
