JURISDICTION – Twersky v. Town of Hempstead

OPINION – One part of a family objected to a structure planned for a commonly-owned burial plot, and informed the town of the construction. The town would not process the building permit application without a signature from the cemetery (which would not give it without all the plot owners’ permission). Without a decision on the application, the matter is not ripe. (E.D.N.Y.)
