BRIEF – Plaintiff Medicaid providers object to the elimination of adult day health care under Medicaid, and the reduction in reimbursement rates pending the elimination. Defendants argue the district court was correct in finding that plaintiff could not assert the interests of Medicaid beneficiaries, because those beneficiaries have already settled their similar case. CIVIL RIGHTS - Tsao v. Desert Palace Inc.
OPINION - Professional gambler barred from entering casino evaded detection with false names, and claimed that promotional offers in her possession rescinded “trespass” orders. Her §1983 and false arrest claims were dismissed. (9th Cir.)
TRADE SECRETS – Fuhu Inc. v. Toys R Us Inc.
OPINION – Fuhu distributed its Android tablet-for-kids through Toys R Us, which later announced plans to produce its own tablet very similar to Fuhu’s. Fuhu claimed Toys R Us misappropriated Fuhu’s business and marketing plan, but the court concluded that the business plans were too general to be considered trade secrets. (S.D. Cal.)
