CONSUMER PROTECTION – Schwartz v. L’Oreal U.S.A. Inc.
COMPLAINT – Schwartz’s class action claims L’Oreal falsely advertised Lancome anti-aging products, with statements such as “boosts the activity of genes and stimulates the production of youth proteins,” and “visibly younger skin in 7 days.” For the claimed violations of California’s Unfair Competition and Untrue Advertising laws, Schwartz seeks disgorgement. CONTRACTS – Rancho Esperanza LLC v. Dinesh D’Souza
COMPLAINT – Plaintiff was established to invest in and exploit the film, “2016: Obama’s America,” based on a book by D’Souza. Plaintiff owns all rights to the film and ancillary works, and claims D’Souza has written a new book capitalizing on the success of the film for his own benefit, in violation of the parties’ agreement. Plaintiff seeks the proceeds from the new book. (Cal.Super.)
HEALTH CARE – Cal. Med. Assoc. v. Douglas
BRIEF – Plaintiff Medicaid providers object to the elimination of adult day health care under Medicaid, and the reduction in reimbursement rates pending the elimination. Defendants argue the district court was correct in finding that plaintiff could not assert the interests of Medicaid beneficiaries, because those beneficiaries have already settled their similar case. (9th Cir.)
The California Fair Political Practices Commission wants access to information about donors to the Arizona non-profit to evaluate if those donations comply with state campaign finance laws.
