SENTENCING - People v. Leal

OPINION - Defendant, out on bail for a robbery case, was apprehended on suspicion of distributing marijuana. Although he had authorization to smoke it for medical reasons, the court was justified in imposing as a condition of probation that he not do so, as authorization was a front for distribution. (Cal.Ct. App., 1st Dist.)

TORTS - Livingston v. Kemper Sports Mgmt. Inc.

ORDER - Plaintiffs’ father was terminated from his job and days later died of a heart attack allegedly brought on by stress and anxiety. Court permitted amendment of discrimination claim to include wrongful death. (E.D. Cal.)

BUSINESS LAW - Baba v. Hewlett Packard Co.

ORDER - Where Hewlett Packard computer suffered “crazy cursor” malfunction, HP’s motion for summary judgment on claims including breach of express warranty was granted. There was no evidence HP “refused or otherwise failed to pay for the…repair.” (N.D. Cal.)
