Unable to introduce priority legislation in Delhi Assembly
Thwarted from introducing the Delhi Jan Lokpal Bill, Delhi Chief Minister Arvind Kejriwal resigned on Friday, 48 days after he assumed power, and recommended the dissolution of the State Assembly.
In a letter sent to President Pranab Mukherjee through Lieutenant Governor Najeeb Jung, Mr. Kejriwal recommended the “immediate conduct” of elections.
The resignation came hours after his government could not introduce the Bill in the Delhi Assembly as 42 MLAs — 32 of the BJP, eight of the Congress and one of the Janata Dal (United) and an Independent — opposed it in the 70-member Assembly.
While announcing his resignation to cheering supporters at his party office, where he went from the Assembly, with his trademark muffler around his head, Mr. Kejriwal attacked the Congress and the BJP for stalling the anti-corruption legislation and linked it with his government’s decision to register an FIR against Reliance Industries head Mukesh Ambani.
“When we tried to pass the Delhi Jan Lokpal, the Congress and the BJP ganged up to stall it. Why did this happen? Because three days back, we registered an FIR against Mukesh Ambani who runs this country. For last 10 years, he was backing the UPA government, but for the last one year, he is behind Narendra Modi. From where does Mr. Modi get so much money?” he asked alleging a “nexus” among the Congress, the BJP and Mr. Ambani.
“People from the Congress and the BJP know if this law is brought in, their leaders will end up in jail. They realised that after we booked Mukesh Ambani and Union Minister Veerappa Moily, if we pass the Jan Lokpal Bill then other senior leaders like Sharad Pawar and Kamal Nath may be next in line,” he said.
Before facing defeat on the introduction of the Bill in the afternoon, the Assembly was repeatedly disrupted in the morning as the Congress and the BJP demanded that Speaker M.S. Dhir read out a written “message” from the Lieutenant Governor over the constitutional status of the Bill. The Bill was listed as the last item, but it ended up dominating the Assembly proceedings.
Finally, Mr. Dhir read out the message and allowed the Chief Minister to table the Bill and directed a discussion on it. This led to chaos and the House had to be adjourned and the Speaker called an all-party meeting.
When the Assembly reconvened, the Speaker decided to get a sense of the House whether the Bill could be introduced, where the motion was defeated. Apart from 27 MLAs of AAP, its rebel MLA, Vinod Kumar Binny, voted in its favour.
Reacting to Mr. Kejriwal’s resignation, Delhi Congress chief Arvinder Singh said: “We did not withdraw our support. Had that been the case, we would not have supported the Appropriation Bill that was taken for voting after the Lokpal Bill.”
BJP leader Harsh Vardhan appeared surprised, saying he did not believe that Mr. Kejriwal would actually carry out his threat to resign.
Features of Delhi Jan Lokpal Bill
1. Provides for establishment of Lokpal to investigate offences under the Prevention of Corruption Act, 1988.
2. Provides for expeditious investigation and prosecution of offenders to deal with “corruption, public grievances and non-delivery of services.”
3. The Jan Lokpal shall have “administrative, financial and functional independence from the government of the National Capital Territory of Delhi.”
4. “Transparency in administration and probity in public life” should be the twin responses of an efficient and effective administration. “Corruption is a key factor in economic underperformance and the major obstacle to poverty alleviation and development and general disenchantment in public.”
5. In a departure from the central Lokpal and Lokayuktas Act, 2014, the Bill provides for redress of public grievances and protection to whistleblowers. The Jan Lokpal shall have jurisdiction over the Chief Minister, Council of Ministers, Members of Legislative Assembly members of local bodies and any category of permanent, contractual or non-permanent employees engaged by the government and members of public authority.
6. Any investigation under the Act shall be conducted by the Jan Lokpal investigation officer, who shall be a Group-A officer. After approval of the Jan Lokpal, the Director of Prosecution shall, within 30 days, file a case before the Special Court.
7. The ombudsman shall have the powers to suo motu initiate appropriate action on receiving information about corruption. The officers authorised to investigate an offence under the Act shall have the same powers as vested in a police officer under the Code of Criminal Procedure, 1973.
8. The Jan Lokpal shall comprise a chairperson and six other members.
9. The ombudsman will have the powers to recruit investigating officers. It will be empowered to temporarily attach property and assets acquired by accused public servants in certain cases as well as recommend cancellation or modification of licence, lease pacts etc if obtained by corrupt means.
10. It shall have the powers to issue directions for transfer or suspension of an accused person under investigation if it is apprehended that the person may tamper with evidence or influence witnesses.

You forget the fact that the BJP and the Congress are but 2 sides of the same coin.
Both are thoroughly corrupt and strike deals with dubious individuals and political
parties to further their ends. Accordingly, the Congress has no qualms about
allying itself with a convict viz Lalu Prasad Yadav; the BJP has no regrets in allying
with another corrupt man Yedyurappa and the tax dodging Baba Ramdev.
None of the legacy political parties in India are interested in stamping out the very
oxygen that sustains them - corruption.
AAP cannot taint itself by allying itself with thugs and thieves.

You seem to have the foggiest grasp of Indiaâs history when you make that
preposterous claim. Between 1975 and 1977, Ms Indira Gandhi set aside the
Constitution and declared Emergency Rule. What followed was massive human
rights violations, arrests without warrants, suspensions of political rights, forced
sterilisations etc.
And if you see the Congress & BJP MPs in action - literally - you would be forgiven
if you thought that you were in a zoo. And left wondering what Constitutional rules
were in force.

and their ilk are more known for flouting the Constitution in letter & spirit whilst
amassing ill-gotten wealth.

I would say it was a brilliant STING OPERATION planned and conducted by Kejriwal in assembly to prove to people how BJP and CONGRESS are hand in hand and collude. But the issue is even after the STING OPERATION, BONGRESS is unaware of it and are blinking now. Shameful fellows of same breed who got exposed by AAP.
Let us assume AAP wins next Delhi election with a majority. They will again need
approvals from Centre to introduce a bill !! What is purpose of drama of resignation ?
Sheer waste of public money.
Delhi state government has no control over police and law and order. The chief minister cannot even introduce a bill in legislature...That, even after passing the bill it can be held over is another issue. Then what good is there to cling on such government? However, AK could have allowed the bill to be sent to the central government and waited.
At last a big political drama has come to an end. I had a large hope over AK when he formed the Govt. But he had no agenda or planning or long term vision for Delhi or India. Some times he spoke like a Maoist that "he will disrupt the republic parade". He was never a Chief Minister.
I feel he has a severe ego problem being an 'Aam Aadmi'. He wanted a Bungalow, but could not tell it openly. I know many political leaders who lives a humble life than him, but they never over expose it to live their political life.
I thought he is a newcomer in Indian Politics, so dont know how to thrive in politics. But he is he has proven that he is a big fish in Indian Politics. Everything was a show off, but nothing had happened. If he again comes to power he can make chaos in India. He behaves in such a way that only he is truthful all others are corrupt.
Supporting AAP was a self goal for Congress.

I fully endorse your view. I had high hope on AAP and it is full of theatrics and am not sure
whether AK is a person of sound sense right from beginning with his theatrics on new house.
Saying one thing and reversing it soon. There is no doubt that we need a different political
party from BJP / CONG/ Third front. But this AAP is not the one for it. They think people can
be fooled by these drama.

him & his party to campaign for the forthcoming Lok Sabha elections.
By stalling the Jan Lokpal Bill by the most corrupt national parties,

given enough reason for the voters to sweep them away from the

For forming a minority government, there was a referendum to the general public. For
moving the Janlokpal bill in its unique style after accusing the LG as the Congress agent,
resigning ,recommending dissolution of the assembly and seeking fresh election, referendum
route was not chosen by AAP. It seems AAP was not equipped to administer Delhi and
found the job tougher than mastering rocket science. To cover up its inability , AAP was
unduly banking on corruption charges against all - other than those in its camp- and was
focused on becoming the martyr by all means , at all costs ,at the first available opportunity.
It is betrayal of Delhi voters. Weeding out corruption is not the sole job in governance. The
desire to grow faster as an all India party to capture power at the centre than the need to

There is not much of difference between the Bill passed by the
Parliament and Jan Lokpal Bill. Kejriwal should have got the prior
permission from AG to introduce the bill, instead of these gimmicks.
There is no use of blaming Congress (which gave support) and BJP for his
failure. Ours is a constitutional democracy, not a street side show.
For the 1st time in India, a CM is stepping down realising that he is not able to fulfil his responsibility. Whatever anyone says, he has been honest to the core. He would have done mistakes, but I haven't seen him doing anything that's bad for the people. For that reason and for the reason that I know that BJP and Congress party won't be able to do that, I support AAP. The congress and BJP will continue to do what they used to do. If AAP won't prevail, we will again leave the governance to the hands of people who play dirty politics. We will still have to be on the streets seeking the government for justice on rapes, scandals etc with no results. For those people like me who want a change in our political scenario, I don't think there is anyother way out than to support the only ray of hope. Whether they will fulfil our dreams of a just society in future is to be seen (so far, I think they have done that), but they are the only ray of hope. I suggest everyone to support this change.
I think people are confusing with the good governance. In the last decade lot of foreign firms came to India because of globalization, which helped India and China. But China's govt acted fast and surpassed India in the growth. Where as in India it was middle class which drove the growth and corrupt politicians made money and also trying to claim that hey achieved something. India had clear advantage over china, but lost in the race due to bad governance and deep corruption at all levels center and states.
People of India were losers. Now people got an alternative to select somebody who are honest and with good intentions.
We should vote not for PM candidate but vote your local MP or MLA by properly vetting him or her. PM or CM can be only as good as the MP or MLA you elect. Do not be fooled by the parties who try to project one person as the IDOL. Indians were being fooled like this from 40 years. Lets change that and vote for the honest and best MP and MLA.
It made me feel extremely sad to hear those parting speech of Kejriwal from the balcony of his house.

Constitution of India is written primarily for good governing of our country
While,private industry with enormous power can bend rules perennially for all corrupt and nefarious activities ,why not allow a humble ,energetic chief minister with a noble mission violate few trivial rules for ultimate goodness .
Law of the land is not a sacred cow , it does not always deserve that ultimate sanctity. Violating it,is necessary when it goes against people and the purpose for which it was made.
After all , if only Mahatma Gandhi respected the law of the land ,India would have never got Independence.

Since the party is a novice in politics, it could have arranged issues on the ascending order of difficulties and solved one by one, and also come to terms with the governance. The premature end of the Kejriwal government in Delhi gives one a dull picture of its electoral prospects in the coming Lok Sabha elections.
India requires a revolution to weed out corruptions. It becomes a
accepted norms of the political party to loot the government to
contest election. It becomes a vicious circle and it has to broken for
India to prosper. Throughout the world the funding the political party
is gray area and most of the illegal, corruption starts in funding
political parties. In UK no political party can get donations in cash
more than 5000 pound and all donations more than 5000 pound should be
through banks transaction only. But people had found out ingenious way
of depositing cash of more than 5000 pound by various names by the
same person. But the alert people, opposition party, banks found out
and caught the person. By giving money without record the donor is
corrupting the government and he can do more damage to the country as
it is happening in India. In Indira Gandhi rule, she made a central
budget to favour Reliance and FM during that period was none other
than the President Pranab Mukarjee.
In India, over the years everyone has become so corrupt and also so used to corruption, that we have taken it as a way of life. Right from getting the birth certificate to the death certificate, we have to pay (albeit)small amounts as bribes. The only way to fight corruption is to have strict laws and prompt punishments. Since there is no moral education inbibed in our youth, only the law can save us. Needless to mention that ethics and morals should be imbibed in the children right from day one. Mr. Kejriwal may be finding himself pitted against corrupt politicians from all parties. As they say Truth can walk naked but lies (corruption) needs a lot of dressing.

AAP started to cleanse the country of dirt of bribe culture rooted since a long time and only present day politicians are enjoying and making poor poorer even with lot of effort and rich and corrupt becoming richer without any effort. AAP came to power only on a single point agenda of anti corruption and the Janlokpal is the tool to imp;ement it . What was the option before Kejriwal except to resign? He made every effort to serve the people but was not allowed to do his job by the central government. The way BJP and Congress and a section of the media ganged up against Kejriwal is revealing. But the ground reality is that people are fed up with the existing corrupt system which has turned democracy into a farce. A common man's revolution has started. It may take years to achieve its goal since it is democratic but it is bound to succeed.

JanLokpal cannot fight corruption as it would be another govt. body
just like existing institutions. To tackle corruption we need moral
education from KG to PG. Morality and humanity only answer to
corruption free country. These AAP people see all roots of todays
Indian scenario lies in corruption. But they should understand that
the corruption is relative to others dimension and not an
independent phenomenon.To eradicate corruption, we must have to
eradicate poverty through governance, development and education.

The resignation by the AAP govt is a betrayal to the people of delhi as
the ruling party had to convince the opposition about janlokpal, but
this resignation shows hisz opportunistic approach for loksabha but i
think forgets that delhi has seen him n in upcoming elections he can

As of now Delhi CM should obey the Lt Governor as per the
constitution.He takes oath as per the constitution.Disobeying is
ridiculous.His popularity is every minute changed like Stock Market.
Not sure what was the hurry for AAP for introduction of the bill without completing all the required formalities. This is unfortunate & if AK claims that he wants to have corruption free administration then he should show patience & comply with all the required formalities. But the actions of AAP in the last couple of weeks have given enough indication that they do not want to run the government & have been trying all possible means to make the Congress withdraw the support. Today they knew that both BJP & Congress will not allow the bill to get it passed in the present format & thus it will get the opportunity to resign which is what seems to be happening. He also has invited all his close family members to the house to see him sitting on the CM chair, these are enough indications that AAP would resign from the govt after today's happening in the house. If they feel that this will give them edge in Parliament elections they are sadly mistaken as people very well know their escapism.
He should not resign. There are other task he has to complete and benifit people of Delhi.

Sheila Dikshit government passed thirteen bills without prior approval
from the central government. Moreover, she had called a special
session of assembly to condemn the rule 55 which the NDA government
had proclaimed for Delhi. Now why is Congress harping on prior
approval procedure ? The idea of both BJP and Congress seems to block
the bill on this excuse. On the other hand, AAP wants to go as martyrs
fighting against corruption only to come back with more strength.
Later can not be blamed for this as they are now adopting a political
strategy as any other political party in search of increased
popularity. It seems that BJP and Congress both will emerge as fools

AAP agenda is now very clear mis guide the people to gain vote for

1. Why is AAP not taking support of BJP (which should be enough to
pass the bill with majority) when they are repeatedly telling that are
in favour of this bill if they are ready to discuss with them on the
bill and amend changes if required together?

As we know that LG is a congress member but undoubltlye is a honest person.It is the time when he has to pay congress debt so he is paying. The whole idea that Jan Lokpal will stamp out corruption is so flawed.
Adding another layer to CVC, CBI, ACB, Police and myriad other agencies
is NOT the solution Mr. Kejriwal. Fight corruption by bringing in
transparency, greater level playing field in business, more education
and health services to all, better infrastructure, better security.
Please do not Talibanize the Jan Lokpal bill. Debate and listen to
dissenting voices. Then take an informed decision to pass the law.
The psychology of most AAP supporters is to blame others if they are
not on their side..if the media do not praise AAP then the start
criticizing media. These supporters don't even understand what is
happening in the assembly.
There are few steps to pass any bill and they have to be followed and
cannot be bypassed. If the delhi government itself doesn't follow then
how can one expect common man to follow. This would kill the
democracy. A simple example is somnath bharathi's midnight raid along
with the local mob. After which there were more than three major
incidents of racism.
Recent waiver of power bills to those who defaulted!! Meaning those
who supported AAP (by not paying electricity bill after advice from
AAP
during election time) need not pay their bills. This is direct bribing

Mr Kejriwal and the AAP need to understand that ultimately, even they
are framing some rule, some law. If he wants that rule to be taken
seriously by the people, he should follow rules himself. He wants a
law passed without debate. He however, does not want to explain his
ministers' behavior. How is he any different from the
'lawless'politicians he is replacing? He has just announced a subsidy
for all those who did not pay their bills. No matter if all those who
paid the bill were honest, sincere citizens. Tomorrow, someone will
say, 'don't pay tax, it is all being used to subsidize vote-bank
subsidies'. What then? He has to learn civil behavior and manners, not
behave like a kid who's suddenly got the TV remote, swapping channels
and creating chaos. You can either bully a man to do a thing, or
explain and reason with him and convince him to do the same. Which one
is better? To say that 'everyone else is beyond reason' is untrue, and
is promoting hatemogering.
With each passing day AAPs tectics are exposing deep rooted corruption in BJP and Congress those who have kept their eyes open can see the obvious, blind supporters will be blind. Remember these laws do not exclude AAP, if tomorrow they indulge into corrupt politics they too will be taken to task. For now whatever AAP is doing is forcing a change in Indian political system, once that is in force issues like development, inflation, unemployment etc will fall in place.

that Congress and BJP have gone viral trying to discredit AAP as a part of their

We need strong anti-corruption law, and anyone that opposes such legislation will

the rights of the centre. The nod of the central government is needed
before introducing a bill in Delhi Assembly,which was not taken. The
other vital issue is why a copy of the proposed Jan Lokpal Bill is not
in the public domain. The copy should have been given to MLAs to
decide on the issue. Where is the public referendum,and
transparency? During anti-corruption movement,when Kejriwal was with
Anna Hazare,he had favoured that citizens should be involved in the
law-making. Why he is shying away now? Empty resignation threats
will not work. It cannot be my way or highway. Constitution has to
be followed ,while introducing a bill in the Delhi Assembly.
If AK's hasty move to pass the Jan Lokpal bill is being termed as
unconstitutional then depriving India of a central Lokpal Bill for
many decades should be termed a criminal act and whoever involved
in delaying tactics should be made accountable.
The problem we in India have is that we are asked to abide by
unnecessary rules and regulations once it becomes clear than our
act will bring misery to cheaters. Tell me which Constitution
Maker of India will be unhappy to see a strong bill gating passed
in the Assembly merely because it does not gave central nod?
Let the Capital test a bill which intends to infuse hemoglobin
into the anemic Mother India suffering from multi-faced
corruptionatic syndrome.

A Governor remains a mute spectator when the ministers indulge in mega scams and loot public money. But when a honest chief minister attempts to introduce a law to prevent corruption, the governor proactively goes to prevent such moves.
If an assembly speaker has to conduct the business of the assembly only on the dictates of the assembly, and if "the procedures" say an elected chief minister cannot bring in any law without the consent of the masters in Delhi, why do we need such assembly?
Instead of opposing Kejriwal Govt's move in assembly, it appears Congress, especially the arrogant government at center, has found LG as a conduit to block the bill. At the same time, arrogance and misdeeds of one party cannot be justified with arrogance that AAP is showing. AAP should seek the legal remedy and rid Delhi of this nuisance once for all. In the interest of country I support AAP' initiatives, but if AAP legally sorts this out, I will feel good. Unfortunately, time in not their favor.
Which constitutional procedure says a Governor, an appointee of the party at the centre, can dictate terms to the speaker of the assembly? Are Governors in India following the democratic norms of the country? Have they not been giving scant regards to the laws and in the past dismissed elected governments, serving the party that appointed them?
The biggest problem, the country facing now, is corruption. We need urgent measures to contain the scams happening on daily basis. We need strong laws for protecting the nation from the criminals and corrupt. Jan Lok Pal provides the hope for this. Kejriwal should go ahead and place the bill in the assembly.
Go ahead with your decision. The constitution is supreme not the letter
of the Home Ministry which is un-constitutional itself. Kick out the

The people of Delhi gave an over whelming support to the AAP to enable them to deliver. But the confrontation attitude of the party disappoint not only the people voted for it but also the people who wish to vote for it in the coming general elections. The Delhi government should respect the Constitution while fighting against corruption.
When a Government can ignore the legal advice of its head of the state
who will follow the advice of such a government ?
If AAP Government thinks advise given by Lt. Governor is against the law
they can approach Court. Resorting to resignation will be an excuse and
pre-planned activity of AAP.
