Elsevier Personal Digital Subscriptions terms and conditions for: ClinicalKey, ClinicalKey Student, ClinicalKey Now, ClinicalPharmacology, StatDX, ExpertPath, ImmunoQuery, RadPrimer, PathPrimer

The parties hereto agree as follows:

1. Products

Elsevier hereby grants to Authorized Users (as defined below) a non-exclusive, non-transferable, right to access and use the content and functionality of:

Content and functionality includes ongoing updates to then-existing content, and any ongoing enhancements to then-current functionality (collectively the “Subscriptions”) subject to the terms and conditions of the Elsevier Website Terms & Conditions on [https://www.elsevier.com/legal/elsevier-website-terms-and-conditions], which is incorporated in this Agreement by reference.  The Subscriptions are “Products” (as defined in the Elsevier Website Terms and Conditions).

2. Authorized Users

Authorized Users are the named purchaser of the Subscriptions.  In the event that named purchaser is procuring Subscriptions for additional named individuals who are employees of the named purchaser, then such additional named employees shall also be considered Authorized Users. For avoidance all Authorized Users must have their own paid access credentials in order to access the Subscriptions.

Only for ClinicalKey Now: Authorized Users shall be limited to the named purchaser of the Subscriptions who currently maintains an authorized license to practice medicine or is training to become a certified clinician.  For avoidance of doubt, all individuals must have their own paid access credentials.

3. Authorized Users

Each Authorized User may:

  • access, search, browse, use and view the relevant content and functionalities within their paid Subscriptions

  • download and save select portions of the Subscriptions for offline use

  • share a link to select portions of the Subscriptions with other Authorized Users via email or messenger functionality

  • copy and paste portions of content within the Subscriptions for personal non-commercial use

  • print out single pages of the content available within the Subscriptions for personal non-commercial use

For ClinicalKey only, Authorized Users may also:

  • pull figures, images, and tables from the Subscriptions into the ClinicalKey Presentation Maker TM for use in the creation of internal or external presentations for personal non-commercial use provided each copy of the presentation will carry appropriate credit to the content owner

  • download, store and share Level PoC CME credit reports from the Subscriptions for personal use

For StatDX, ExpertPath, PathPrimer, RADPrimer, ImmunoQuery only, Authorized Users may also:

  • download images from the Subscriptions for use in the creation of internal or external presentations for personal non-commercial use

  • share images and individual diagnostic topics from the Subscriptions with colleagues individually for collaboration on a patient case or for scholarly or educational research use;

  • download, store and share Level PoC CME credit reports from the Subscriptions for personal use

For Clinical Pharmacology, Authorized Users may also:

  • print out monographs, and product information and images from the Subscriptions to reactively supply to patients and customers in response to their requests for medical information about their prescription(s) or over-the-counter drug purchases.

4. Access to Subscriptions 

Elsevier will make the Subscriptions accessible using the Individual Access Credentials as set forth herein.

5. Authentication

Access to the Subscriptions will be authenticated by the use of Individual Access Credentials defined as the username/password.

6. Patient Care

Authorized User acknowledge and agrees that Elsevier provides no medical advice in connection with the Subscriptions, that the Subscriptions are designed for and are intended to be used by trained healthcare professionals exercising knowledge and discretion in application of the Subscriptions, and that the duty to the patient in providing healthcare services lies solely with the healthcare professional providing patient care. The information contained in the Subscriptions may include or incorporate third party information which is not subject to evaluation by Elsevier, and the Subscriptions are intended as a supplement to, and not a substitute for, the knowledge, expertise, skill, and judgment of healthcare professionals in patient care. Authorized User assume all responsibilities, duties, and obligations for any treatment, decision, or advice made or given to third parties as a result of the use or application of the content within the Subscriptions.

7. Payment

Payments (including any recurring payments) shall be made in accordance with the methods of payment displayed on the payment information page of the Site and in the currency indicated in the order confirmation email. If Authorized User is paying by credit card or debit card, then Authorized User must supply card details when placing their order. Authorized User’s credit card will be charged before each Term of the Subscription. Elsevier reserves the right to verify the identity of the credit card holder by requesting appropriate documentation from the Authorized User.

8. Term

Access to the Subscriptions will commence on the date indicated on the order confirmation email. a) Single term Subscriptions, i.e. Subscriptions that do not auto-renew are cancelled automatically after the Initial Term ends. Authorized Users can extend the Subscription for another Term by going to the “My Subscriptions” page.

b) For Subscriptions that auto-renew (as stated in the order confirmation e-mail and checkout flow) those Subscriptions will be automatically renewed for successive terms equivalent to the duration of the Initial Term (each a "Renewal Term"), unless either party gives notice to the other no later than the last day at the end of the then current term that it does not intend to renew. The Initial Term and each Renewal Term are collectively the "Term.

9. Product cancellation and Refund Policy

a) Single term Subscriptions, i.e. Subscriptions that do not auto-renew are cancelled automatically after the Initial Term ends. Authorized Users can extend their access to the Subscriptions for another Term by going to the “My Subscriptions” page. Single term Subscriptions are not eligible for any refunds.

b) Subscriptions that auto-renew (as stated in the order confirmation e-mail and checkout flow) can be cancelled at any time before that subscription term ends from the “My Subscriptions” area. The Subscription can be still used until the end of the term of that subscription period. Upon cancellation, such Subscriptions are not eligible for refunds. The exception is where such Subscriptions have an annual subscription Term, where a full refund will be applied if the user cancels the Subscription within 30 days after the annual subscription has auto-renewed.

10. Termination

Upon termination or expiration of the Subscriptions, all access to the Subscriptions shall cease for the Authorized User.However, where applicable for the relevant Subscriptions, any records of Continuing Medical Education credits can be accessed post termination or expiration.
